Please note that this Privacy Policy does not govern the collection and use of information by companies that Hund does not control, nor by individuals not employed or managed by Hund.

We will not use or share your information with anyone except as described in this Privacy Policy.

We use your Personal Information for providing and improving the Service. By using the Service, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

This policy now encompasses the management of system inputs, processing, and outputs, ensuring their completeness, accuracy, and alignment with system specifications to meet organizational objectives.

Our Data Processing Roles

This Privacy Policy addresses our practices for all information we handle. To provide clarity, we distinguish between two roles Hund plays under data protection law:

  • Data Controller: For data we collect from our direct customers and website visitors for our own business purposes (e.g., account management, billing), we are the Data Controller.
  • Data Processor: For data our customers submit to our services (e.g., content for their status pages, lists of their notification subscribers), we are the Data Processor, acting solely on our customers' instructions.

The following sections detail the data we handle in each role.

Notice to End-Users of Our Customers

If you have subscribed to notifications from a status page hosted by Hund, the owner of that status page is the Data Controller of your information. Hund acts as a Data Processor, providing the platform to send notifications on their behalf.

Any questions about your personal data or requests to exercise your data privacy rights (such as access or deletion) should be directed to the company or organization that owns the status page. Hund is contractually obligated to act on their instructions and cannot respond directly to your request.

Information We Handle

1. Account Data: Information Hund Collects as a Data Controller

When you sign up for a Hund account, visit our website, or communicate with us, we act as a Data Controller. We collect information necessary to provide our services and manage our business relationship with you.

What We Collect:

  • Identity and Contact Information: Your name, company name, email address, and phone number.
  • Billing Information: Payment details, which are processed securely by our designated payment processor.
  • Technical and Usage Data: IP addresses, browser information, and data on how you interact with our website and services.

Our Commitments for Account Data:

If you provide this personally identifiable information to us, we commit to the following:

  • We will never sell or rent your Account Data to a third party.
  • We will implement and maintain robust security measures to protect your information from loss, misuse, and unauthorized access, disclosure, alteration, and destruction.
  • We will not use or disclose your information except:
    • To provide, maintain, bill for, and support the Services you have ordered;
    • For our own legitimate business purposes, such as service improvement and security monitoring, often in an aggregated or anonymized form;
    • As required by law, for example, in response to a valid subpoena or search warrant;
    • To our auditors or legal counsel who are bound by confidentiality obligations;
    • As necessary to enforce our Master Subscription Agreement;
    • To protect the rights, safety, or property of Hund, our users, or the public.

2. Customer Data: Information Hund Processes as a Data Processor

When you use our services, you entrust us with "Customer Data." For this data, you are the Data Controller and we are the Data Processor. This category includes all data you submit to the Services, such as:

  • Status Page Content: Information you display on your public or private status pages.
  • Subscriber Information: Personal data of your end-users who subscribe to notifications, such as email addresses or phone numbers.
  • Monitoring Configuration: URLs, IP addresses, and other details of the services you choose to monitor.

Our processing of Customer Data is governed strictly by our Master Subscription Agreement and Data Processing Addendum, which contains our full legal commitments as a Data Processor.

Our Commitment to Purpose Limitation:

Hund is a data processor for the Customer Data you entrust to us. We are committed to using your data solely for the purposes to which you have agreed. Our legal basis for processing your data is the performance of our contract with you. We will only process Customer Data for the following specific purposes:

  • Service Delivery: To provide, operate, maintain, and support the core functionality of the Services as described in the Agreement.
  • Troubleshooting and Support: To investigate and resolve technical issues, respond to customer support requests, and ensure the security and reliability of the Services.
  • Billing and Account Management: To manage your account, calculate fees, process payments, and manage the subscription lifecycle.
  • Service Improvement: To analyze usage patterns and performance metrics for the sole purpose of improving the functionality, reliability, and security of our Services.
  • Security and Abuse Prevention: To monitor for, prevent, and address fraudulent or malicious activity and to enforce our Acceptable Use Policy.

We will never:

  • Sell or rent your Customer Data to any third party;
  • Use your Customer Data for marketing or advertising for any third party;
  • Share your Customer Data with any third party except for our vetted sub-processors as required for service delivery and as listed on our Sub-processors page.

Data Retention

We process and retain Personal Data only for as long as is necessary to provide the Services and fulfill our legal and contractual obligations, in accordance with the principle of data minimization.

  • Active Account Data: We retain your Personal Data for as long as your account is active or as needed to provide you with the Services.
  • Terminated Account Data Backups: Upon termination or deletion of your account, your Personal Data is removed from our active, production systems in accordance with the terms of our Agreement. As part of our essential business continuity and disaster recovery procedures, this Personal Data may remain in our secure, encrypted backup archives for a period of up to 180 days, after which it will be permanently purged in the ordinary course of our automated backup rotation schedule. During this retention period, the backup data is securely isolated, protected from any further processing, and is used only for the purpose of disaster recovery. Should a backup be restored to a production environment, we have processes in place to ensure any data subject requests for erasure that occurred prior to the restore are honored and the data is re-deleted.

Cookies

We are committed to protecting your privacy and do not use any third-party tracking cookies for advertising or cross-site profiling. We utilize a self-hosted, privacy-focused analytics platform to understand how our service is used in aggregate, which does not track your activity across other websites. Because we do not engage in the kind of tracking that Do Not Track (DNT) signals are designed to prevent, our services do not change their behavior in response to a DNT signal from your browser.

We use cookies that are strictly necessary for the Service to function, for example, to maintain your user session, ensure security, and process payments through our essential third-party providers. Because these cookies are required for the operation of the Service, they cannot be disabled without rendering the Service unusable. Our Legal Basis for Processing

We only collect and process personal data where we have a lawful basis. Our legal bases include:

  • Performance of a Contract: We process your data to provide the Hund services you have signed up for, in accordance with our Master Subscription Agreement..
  • Legitimate Interest: We process data for our legitimate interests, such as improving our service, marketing, and protecting our legal rights, provided these interests do not override your fundamental rights and freedoms.
  • Consent: Where required by law, we will ask for your consent to process your data for specific purposes, such as sending promotional emails. You may withdraw your consent at any time.

Your Rights

Data protection laws grant individuals specific rights over their personal data. For access, rectification, or erasure requests, reach out through our designated channels. We communicate these rights and the process for exercising them in our notices. Concerns related to our data handling can be communicated for timely resolution. Individuals also retain the right to approach relevant regulatory bodies. Data subjects have the right to request an accounting of their personal information held by us. Upon such requests, we provide a detailed report of their data and its disclosures.

California Consumer Privacy Act (CCPA) - Do Not Sell or Share My Personal Information: Hund does not sell personal information for monetary consideration, nor does it share personal information for cross-context behavioral advertising or targeted profiling as defined under the CCPA. Because we do not share personal information, the right to opt-out of sharing is not applicable. If you have any questions regarding your California privacy rights, please contact privacy@hund.io.

According to CalOPPA, we agree to the following:

  • Users can visit our site anonymously;
  • Our Privacy Policy is linked to on our homepage or as a minimum on the first significant page after entering the Service;
  • Our Privacy Policy link includes the word Privacy and can easily be found on the pages specified above;
  • Users may contact us using the information below to access, correct, amend, or delete any personal information;
  • Users will be notified of any privacy policy changes as set forth herein.

Disclosure and Consent

We inform data subjects about disclosures to third parties and obtain explicit or implicit consent for such disclosures, especially for sensitive information. We disclose personal information to third parties only with the explicit consent of the data subject. Personal data may be shared under specific legal mandates or during organizational transitions, with the incoming entity maintaining similar protective standards.

International Data Transfers

Hund, LLC is based in the United States, and the information we collect is processed in the United States. If you are accessing our service from another country, your data will be transferred to, stored, and processed in the US. We rely on legal mechanisms, such as Standard Contractual Clauses (SCCs), to ensure that an adequate level of data protection is afforded to any personal data transferred outside of the European Economic Area (EEA). EU Privacy Rights

Hund complies with the requirements of GDPR (General Data Protection Regulation). If you are an individual protected by the GDPR, you are entitled to view, amend, or delete the personal information that we hold. Children's Privacy

Our Service does not address anyone under the age of 16 (Children).

We do not knowingly collect personally identifiable information from anyone under the age of 16. If you are a parent or guardian and you are aware that your Children has provided us with Personal Data, please contact us. If we become aware that we have collected Personal Data from children without verification of parental consent, we take steps to remove that information from our servers.

Monitoring and Review

Any modifications to this policy will be communicated adequately in advance. Continuation of platform usage post-policy update will be deemed as acceptance. We regularly assess and refine our policies and procedures related to system inputs, processing, and outputs to stay compliant with industry standards and best practices. We have established a process for handling inquiries, complaints, and disputes related to data privacy, ensuring timely and effective resolution and compliance monitoring.
